Custom Blueprint, Preconstruction & Refund Policy

  

At Lavish Builders, LLC, we offer custom blueprint and preconstruction services to help clients develop a home design, review layout options, and prepare for construction pricing. Because custom blueprints and preconstruction services are custom to each client and project, the following policy applies to all custom blueprint, design, and preconstruction services unless otherwise agreed in writing.


Custom Nature of Blueprints

Custom blueprints are specifically created based on the client’s requested layout, preferences, design direction, specifications, and project goals. Due to the personalized nature of this work, all custom blueprint and preconstruction payments are final and non-refundable once the design process has begun.

Custom blueprint work may include design discussions, layout review, plan coordination, drafting, revisions, preconstruction review, square footage review, plan review, and preparation of a custom PDF plan set.


Blueprint Pricing

Blueprint pricing is typically calculated based on the total square footage under roof, unless otherwise stated in writing. This may include finished and unfinished areas, garages, decks, porches, carports, basements, crawlspaces, accessible attics, and other design elements.

A deposit may be required before design work begins. Any remaining balance is due before final plans are released.

Blueprint pricing is separate from the construction cost of the home unless specifically stated otherwise in writing.


PDF Plan Set Only

Unless otherwise agreed in writing, custom blueprint services include a PDF plan set only.

Editable files are not included. This includes, but is not limited to:

  • CAD files 
  • DWG files 
  • Chief Architect files 
  • Revit files 
  • Source files 
  • Working design files 
  • Editable drafting files 
  • Unrestricted design files 

Lavish Builders, LLC and/or its plan designer are not required to provide editable files to clients, builders, contractors, suppliers, lenders, municipalities, or third parties.


No Ownership or Copyright Transfer

Payment for custom blueprints does not transfer ownership, copyright, authorship, intellectual property rights, or unrestricted use rights.

Custom blueprints remain protected design documents. The client receives only the right to use the PDF plan set as allowed under this policy and any written agreement between the parties.

The client may not claim ownership of the plans, remove copyright or designer information, resell the plans, reproduce the plans for other projects, or use the plans to build multiple homes unless specifically agreed in writing.


One-Time Use

Unless otherwise agreed in writing, custom blueprints are intended for one-time use for one single-family residence only.

The plans may not be reused, resold, copied, transferred, modified for another project, or used to construct more than one home without written permission from Lavish Builders, LLC and/or the applicable plan designer.


Lavish Builders and Designer Information on Plans

Lavish Builders, LLC and/or the plan designer may remain listed on the plan set, title block, copyright notice, notes, or other plan information.

Removal or alteration of Lavish Builders’ name, logo, title block, designer information, copyright language, or plan notes is not included unless specifically agreed in writing and approved by the appropriate party.


Changes and Revisions

Lavish Builders understands that changes may be necessary during the design process. Unless otherwise stated in writing, two rounds of revisions within the originally agreed scope may be included.

Additional revisions, redesigns, major layout changes, structural changes, site-specific changes, or changes outside the original scope may result in additional fees and may impact the delivery timeline.

After final plans are delivered or approved, additional changes may require a separate fee.


Cancellations Before Work Begins

If the client cancels before any design, drafting, consulting, review, plan coordination, or preconstruction work has begun, the client may be entitled to a refund of payments made, minus a $50.00 administrative cancellation fee.

Once design work, drafting, consulting, review, plan coordination, or preconstruction work has begun, blueprint and preconstruction payments are non-refundable.


Delivery of Final Blueprint

Once the final custom blueprint PDF is delivered and/or approved, no refunds will be issued. Custom blueprints are a unique, custom-created product based on the client’s requested design direction and specifications.

Final plans may be released only after all outstanding blueprint, design, preconstruction, and related fees are paid in full.


Refunds Due to Budget, Financing, or Decision Not to Build

Custom blueprint and preconstruction payments are for design time, drafting work, planning, review, coordination, and preparation of a custom PDF plan set. These services are custom to each client and project and are not refundable once work has begun.

Blueprint and preconstruction payments are not refundable due to:

  • The client deciding not to build 
  • The client being unable to afford construction 
  • The client not qualifying for financing 
  • Construction pricing exceeding the client’s desired budget 
  • The client choosing another builder 
  • The client changing land, project location, or building plans 
  • The client changing their mind about the project 
  • Delays caused by client decisions, financing, approvals, land issues, engineering, permitting, zoning, or third parties 

Payment for custom blueprints does not guarantee that the home can be built within the client’s desired budget. Construction costs depend on many factors outside of Lavish Builders’ control, including but not limited to final design, square footage, site conditions, material selections, labor costs, engineering requirements, permitting requirements, utility requirements, market conditions, financing terms, and work performed by others.

Any preliminary pricing, square-foot estimate, budget discussion, or rough construction estimate provided before final plans, specifications, selections, engineering, site conditions, and subcontractor pricing are complete is for general planning purposes only and is not a guaranteed construction price.

Once design work, drafting, revisions, preconstruction review, or final PDF plan preparation has begun, payments are non-refundable, even if the client later decides not to build or is unable to move forward with construction.


Items Not Included Unless Specifically Stated

Unless specifically included in writing, custom blueprint and preconstruction services do not include:

  • Architect-stamped plans 
  • Engineering 
  • Structural calculations 
  • Truss layouts 
  • Roof truss engineering 
  • I-joist layouts 
  • Lumber layouts 
  • Site plans 
  • Surveys 
  • Septic design 
  • Soil testing 
  • Civil engineering 
  • Grading plans 
  • Energy calculations 
  • Permit fees 
  • Zoning approvals 
  • HOA approvals 
  • Construction pricing 
  • Construction management 

Some of these items may be required by a lender, township, county, building department, engineer, supplier, or builder and are the client’s responsibility unless otherwise agreed in writing.


Use With Another Builder

If the client chooses not to build with Lavish Builders and wants to use the PDF plan set with another builder, a written plan release may be required.

Lavish Builders may charge a plan release, license, or administrative fee before a written release is issued.

Lavish Builders is not responsible for construction, pricing, estimates, budgets, code compliance, field changes, site conditions, engineering changes, permitting, workmanship, materials, delays, defects, or modifications made by another builder, contractor, supplier, or third party.

The new builder and/or appropriate licensed professionals are responsible for verifying all dimensions, site conditions, engineering requirements, code requirements, selections, materials, and construction details before construction begins.


Client Responsibility

It is the client’s responsibility to review all documents, drafts, layouts, details, dimensions, specifications, and designs during the approval process.

The client is responsible for making sure all requested details, preferences, and specifications are accurate and complete before approving final plans.

Client is also responsible for notifying Lavish Builders of any budget concerns, financing limits, property restrictions, zoning issues, lender requirements, or design limitations before and during the design process.


Exceptions

Refunds, cancellations, or adjustments may be considered under exceptional circumstances, such as:

  • Lavish Builders is unable to deliver the blueprint within the agreed-upon timeframe, excluding delays outside Lavish Builders’ control. 
  • There is a material error in the blueprint that significantly deviates from the specifications approved by the client and the error was caused by Lavish Builders or its design team. 

Any exception must be approved in writing by Lavish Builders.


Acceptance of Policy

By making payment for a custom blueprint, blueprint deposit, design service, or preconstruction service, the client acknowledges and accepts this Custom Blueprint, Preconstruction & Refund Policy.

By proceeding with payment, the client understands that blueprint and preconstruction payments are non-refundable once work has begun, that the standard deliverable is a PDF plan set only, and that editable files, ownership transfer, copyright transfer, architect-stamped plans, engineering, and unlimited reuse rights are not included unless specifically agreed in writing.
